Terms of Service

Welcome to Cutria. These Terms of Service ("Terms") govern your access to and use of the Cutria website, mobile applications, and services (collectively, the "Service"), provided and operated by Plotnikov LLC, a Texas limited liability company with its registered office at 5900 Balcones Drive, STE 100, Austin, TX 78731, United States ("Cutria", "we", "us", or "our"). By using Cutria, you agree to be bound by these Terms.

1. Description of Service

Cutria is an intelligent workspace for video creators, providing tools for project management, scriptwriting, and team collaboration. The Service includes various subscription tiers affecting storage limits and available "Project Slots."

2. Accounts and Registration

• To use certain features, you must register for an account.
• You are responsible for maintaining the confidentiality of your account credentials.
• You must be at least 13 years old (or the minimum legal age in your country) to use the Service.

3. Subscription Plans and Payments

• Where you buy: Subscriptions are sold through the Apple App Store (iOS app), Google Play (Android app) and, on the web, through Stripe. Web purchases are sold by Stripe (Stripe Payments Company or Stripe Technology Europe, Limited) as the merchant of record on behalf of Plotnikov LLC, using Stripe's Link checkout: your card statement shows LINK.COM* CUTRIA, receipts and invoices are sent by Link, and Link's terms apply to the transaction. The store you buy from processes the payment and applies its own terms; a subscription is managed, changed and cancelled in the store where it was purchased.
• Billing: All plans and storage levels are billed monthly and renew automatically until cancelled. Prices are listed in US dollars. On the web the applicable sales tax or VAT is added at checkout; App Store and Google Play prices include local taxes. Upgrades take effect immediately and are prorated by the store; downgrades take effect at the end of the current billing period.
• Refunds: See our Refund Policy. Refunds for App Store and Google Play purchases are handled by Apple and Google.
• Project Slots & Storage: Your ability to manage active projects and media assets is limited by the parameters of your selected plan.
• When a paid plan ends: If your paid plan expires, is cancelled, refunded or otherwise ends and is not renewed, your account returns to the free Personal plan. Everything that does not fit into the Personal plan is removed permanently: team workspaces are deleted, projects are archived into your personal workspace, and all uploaded media assets (video, audio, images, documents) are deleted from our storage and cannot be recovered. We send at least one warning email to the address on your account before this happens. Export or download anything you need before your plan ends.

4. User Content and Conduct

• Ownership: You retain all ownership rights to the content (scripts, ideas, media) you upload to Cutria.
• License to Us: By uploading content, you grant Plotnikov LLC a worldwide, non-exclusive license to host, store, and display your content solely for the purpose of providing the Service to you.
• Prohibited Content: You may not upload content that is illegal, infringing on intellectual property, or contains malware.

5. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

6. Limitation of Liability

IN NO EVENT SHALL PLOTNIKOV LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; OR (B) ANY UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

7. Governing Law

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict of law rules. Any dispute arising from these Terms or the Service shall be brought in the state or federal courts located in Travis County, Texas, and you consent to their jurisdiction.
